Ex-VP Mphoko bail conditions relaxed


Ex-VP Mphoko bail conditions relaxed. Mphoko was represented by Zibusiso Ncube when he appeared before Harare regional magistrate Trynois Utahwashe for the continuation of his corruption case. Mphoko is being accused of illegally ordering the release of two suspects, then Zimbabwe National Road Administration officials David Norupiri and Moses Juma, from lawful custody during his tenure of office in 2016.

Former vice president Phelekezela Mphoko yesterday had his reporting conditions scrapped after submitting that he feared contracting coronavirus following reports of positive cases in Plumtree last week. The case will be back in court on June 23 for arguments on his application for an exception in which he argued that he was protected by presidential immunity when the alleged offence was committed.

“The accused person’s reporting conditions still persist, but just on Friday it was reported that people that interacted with court officials tested positive for coronavirus in Plumtree, which is close to Bulawayo where the accused person resides,” Ncube said.

“We are applying that the reporting conditions be suspended until a time when there is scientific evidence of flattening of the curve. “By virtue of his status, the accused person has two police officers guarding him such that no prejudice will be suffered by the State if reporting conditions are removed.”

Prosecutor Lovert Masuku did not oppose the application. Masuku alleged that on May 6, 2016, the Zimbabwe Anti-Corruption Commission received a report of allegations of fraud and criminal abuse of duty by Norupiri and Juma.

The two were then arrested and detained at Avondale Police Station pending their appearance in court. It is the State’s case that at around 6pm the same day, Mphoko, who was at the time acting president, stormed the police station and ordered the pair’s release from custody.
