A 61-year-old man from Chinhoyi has been sentenced to six years in prison after he was found guilty of culpable homicide for fatally striking his wife of 49 years twice on the head with a log. Kasina Kawocha will effectively serve four years, with two years of his sentence suspended pending good behavior, as ruled by Chinhoyi High Court judge Justice Philda Muzofa.
The incident occurred on August 30, 2023, when Kawocha, following a disagreement, struck his wife, Spejina, with a log after questioning her about not bathing his nephew. Despite pleading not guilty to murder, Kawocha admitted to culpable homicide.
Justice Muzofa emphasized that Kawocha’s actions, which led to his wife’s death, were negligent. She acknowledged that while conflicts are inevitable in marriages of long duration, resorting to violence was a choice Kawocha made. She criticized his lack of remorse and failure to engage with his wife’s relatives after the incident.
In mitigation, Kawocha portrayed himself as a responsible family man with extended family ties. However, Justice Muzofa pointed out the severity of his actions, noting that striking the victim on her head—a vulnerable part of the body—twice and delaying her access to medical assistance exacerbated the situation.
The judge concluded that the sentence should exceed the presumptive penalty due to the high moral blameworthiness of the accused. She also highlighted the personal consequences for Kawocha, including the stigma of killing his wife and his inability to participate in her burial while in custody. Overall, Justice Muzofa’s verdict reflected a balance between acknowledging the tragic outcome of a domestic dispute and holding Kawocha accountable for his negligent and fatal actions.
