“Real Housewives of Atlanta” alum Eva Marcille’s estranged husband, Michael Sterling, is being sued for allegedly causing a car accident while driving under the influence.
However, the former mayoral candidate has denied any wrongdoing via his attorney.
Kody Clark claimed in the suit, obtained by RadarOnline Monday, that he was driving a 2014 Toyota Camry on Feb. 4, 2022, in a “safe, careful, prudent manner” in Sandy Springs, Ga., with Lauren Hammett as a passenger.
Sterling, 39, was driving a 2011 Ford Mustang GT in an adjacent lane on the highway when he allegedly “slamm[ed] directly into the rear of [the Camry], causing it to spin out of control until it collided with the concrete median on the right side of the road,” per the documents.
Clark and Hammett alleged that Sterling, an Atlanta-based lawyer, was “driving recklessly and following too closely.”
They further alleged that the founder of 925 Sterling Legal was “negligently, carelessly and unlawfully” operating his vehicle “by driving under the influence.”
Clark and Hammett claimed they were “hurt and suffered multiple injuries” that incurred medical bills in excess of $2,000.
They added in their suit that they’ve suffered mental and emotional distress as well as lost wages, claiming they are unable “to live a normal life” due to the “violence of the collision.”
Though Sterling has yet to respond to the lawsuit directly, his attorney wrote a letter to prosecutors in April 2022, insisting that his client “was not driving under the influence of alcohol that night.”
Although Sterling “had worked a long day” ahead of the crash, his attorney maintained that the father of three was “fully oriented, awake, alert and cooperative.”
Sterling’s lawyer went on to claim that his client was brought to the emergency room following the accident, where “an independent medical examination was performed by medical professionals in the presence of the officer” who had responded to the scene.
“The medical professionals disagreed with the officer and indicated in their report that ‘despite injection of his eyes, [Sterling] otherwise does not have any slurred speech or inebriation at this time,’” his lawyer claimed, noting that “no odor or smell of alcohol” was mentioned in the medical report, either.
As for the “injection of his eyes,” Sterling’s attorney claimed his client was diagnosed with conjunctival edema — a condition characterized by “redness, swelling and watery eyes” — a few months before the crash and was prescribed a steroid that he “uses … to this date.”
Additionally, his attorney pointed out that “the accident occurred on a rainy night on a highway with ongoing construction.”
Sterling did not immediately respond to Page Six’s request for comment.
