A three-judge panel voted to uphold Jessie Smollett’s conviction. He was arrested in 2022 for allegedly faking a racist and homophobic hate crime and the deed comes with a 150-day sentence in an Illinois prison. Judges handed down a 2-1 decision, according to court documents obtained by The Mirror.
Jussie was originally indicted by a grand jury on 16 counts of felony disorderly conduct after the false reporting. Thereafter, he was reindicted on six counts and convicted of five. The documents explained further explained the decision from a jury trial included a 30-month probation and “a $25,000 fine and $120,106 in restitution to the City of Chicago.”
Jussie still has the option to appeal to the Illinois Supreme Court. However, the higher level court would choose whether or not they’d like to hear the case as it is not guaranteed, so he is far more likely to serve out his sentence.
He argued during the appeal process that “his rights to a fair trial and due process were violated when the [Office of the Special Prosecutor] committed several acts of prosecutorial misconduct.” The judges disagreed with his argument, citing a variety of case law precedents.
After a 6 day stint in jail, Jussie was initially released while legal action was pursued. During that time, he was able to release new music and direct a film with Vivica A. Fox. He also went to rehab.
During Jussie’s initial sentencing, he had an outburst in court where he reacted by repeatedly reminding those in the room that he was not suicidal and that if he died in prison, it would not be his own doing.
In a video from WGN, he said: “I am not suicidal. I am innocent and I am not suicidal. If I did this, then it means I stuck my fists in the fears of Black Americans in this country for over 400 years and the fears of the LGBTQ community.”
“Your honor, I respect you and I respect the jury, but I did not do this,” he said with his hands in front of him in a ‘praying’ motion. When the court was adjourned, Jussie was escorted from the room into the custody of the sheriff with his fist in the air.
